LBW AR Try-On Monthly Software Agreement

LBW AR Try-On Monthly Software Agreement Effective Date: April 18, 2026 This Monthly Software Agreement (“Agreement”) is entered into between Local Business Websites (“Company,” “we,” “us,” or “our”) and the customer (“Customer,” “you,” or “your”) purchasing or using the LBW AR Try-On monthly software plan. 1. Software Access The LBW AR Try-On monthly plan provides the Customer with access to the licensed software for self-installation and use on the Customer’s website, subject to the plan selected and continued active payment. 2. Monthly Billing By purchasing a monthly plan, you agree to pay the monthly fee associated with your selected plan on a recurring basis unless and until the subscription is canceled. Failure to make payment may result in suspension or termination of access to the software, license, updates, support, downloads, or related services. 3. No Guarantees The software is provided as-is and as available. Local Business Websites makes no guarantees, warranties, or promises regarding: - uninterrupted operation - error-free performance - compatibility with every website, theme, plugin, device, browser, or server environment - specific sales, conversion, revenue, or business results - exact visual rendering, color matching, or product appearance through AR try-on We do not guarantee that the software will meet every business need or function perfectly in every environment. 4. Customer Responsibility The Customer is responsible for: - installing the software correctly - maintaining a compatible website environment - keeping WordPress, WooCommerce, themes, plugins, and hosting settings reasonably up to date - following provided setup instructions - ensuring they have the rights to use the images, products, branding, and content added to the software 5. License and Use This monthly plan grants the Customer a limited, non-exclusive, non-transferable license to use the software while the subscription remains active and in good standing. The Customer may not: - resell, sublicense, lease, or redistribute the software - copy, reverse engineer, modify for resale, or create competing derivative commercial versions from the software - remove licensing, branding, or ownership notices where prohibited - share download access or license access with unauthorized third parties 6. Support and Updates Monthly plans may include access to software updates and limited support based on the purchased plan. Support does not include custom development, custom integrations, advanced troubleshooting unrelated to the software itself, or third-party platform issues unless separately agreed in writing. 7. Suspension or Termination We reserve the right to suspend, disable, or terminate access to the software, downloads, license keys, updates, or support if: - monthly payment fails - chargebacks or payment disputes are filed - the software is misused - the license is shared, abused, or used in violation of this Agreement - the Customer engages in fraudulent, harmful, or unauthorized activity 8. Cancellation The Customer may cancel the monthly subscription at any time before the next billing cycle. Cancellation stops future billing but does not refund the current billing period. Upon cancellation or nonpayment, software access, support, updates, downloads, or license validation may be suspended or terminated. 9. Refunds Because this is digital software access, monthly payments are generally non-refundable once charged, except where otherwise required by law or expressly approved by Local Business Websites in writing. 10. Limitation of Liability To the fullest extent permitted by law, Local Business Websites shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business, downtime, lost sales, or compatibility issues arising out of or related to the use of the software. 11. Intellectual Property The software, code, systems, design methods, branding structure, and related materials remain the property of Local Business Websites unless expressly stated otherwise in writing. Purchase of a monthly plan grants use of the software only, not ownership of the software itself. 12. Changes to Agreement We may update this Agreement from time to time. Continued use of the software after updates are posted or provided constitutes acceptance of the revised terms. 13. Acceptance By purchasing, downloading, installing, accessing, or using the LBW AR Try-On monthly software, you acknowledge that you have read, understood, and agreed to this Agreement.
